Every order constitutes acceptance by the buyer of our general terms and conditions. These general terms and conditions form an integral part of the agreement as described below. Quotations, order acceptance and prices
All our quotes are without obligation. We are only bound by an order after we have confirmed it in writing or after we have started execution. The information regarding the products and pricing, as well as the detailed order information, has been drawn up and communicated subject to change and correction.
All prices of products and services on this website are stated in Euro and include VAT (6% or 21%). Transport costs, taxes and other levies are not included, unless otherwise stated or explicitly agreed in writing.
Shipping costs are added after placing an order and payment can be made through the options indicated during the ordering process. The date on which the sum to be paid is in BAM Coffee's bank account is assumed as the date of payment.
All offers from Bam.coffee are free of obligations. Bam.coffee may change prices at any time without notice. Invoicing is based on the amount on the order confirmation. If the product and service prices should increase between the date of order and the execution of the order, the buyer has the right to cancel the order or the agreement within 14 days after Bam.coffee has announced the price increase.
Delivery
Products are only delivered to the countries for which the website allows delivery. The delivery of products will, as far as possible, take place within the time specified in the individual order confirmation.
Incorrect delivery addresses provided are the responsibility of the buyer and may give rise to additional costs. Unless otherwise stated, our prices do not include the transport and delivery of the goods to the buyer. The costs of transport and delivery are stated separately.
The stated delivery times are not binding, but are merely given as an indication. No delay in delivery can give rise to termination of the purchase or payment of damages in favor of the buyer, except in the case of intentional delay. We have the right to make partial deliveries. In the event of non-delivery of the goods, any sums paid by the buyer will be refunded without interest or other compensation.
The buyer is responsible for all additional taxes and levies. Bam.coffee cannot be held responsible for any fees charged by a third party.
Force majeur
We are not liable for any delay in execution or for a failure to fulfill our obligations due to events beyond our normal control, including production interruptions, difficulties in supply or shortages of raw materials, labor, energy or transport or delays in transport, strikes, lock-outs, work stoppages or other collective labor disputes, that affect either ourselves or our suppliers, and this even if these events are foreseeable.
Guarantee
Our guarantee is limited to the guarantee for hidden defects and the guarantee in the event of a consumer purchase, both provided for in the Civil Code. We are only liable for damage resulting from intent or gross negligence.
We are not liable for general or special indirect damage, of whatever nature suffered by the Buyer.
To be admissible, complaints must reach us: (a) in the case of a complaint due to non-conforming delivery, eight (8) days after delivery and (b) in the case of hidden defects, eight (8) days after discovery of the defect or after the time at which such discovery could reasonably have occurred. The receipt of the goods by the buyer covers any possible defect or non-conformity that could then be identified.
Right of renunciation
In the context of distance selling to consumers who live indoors fall within the scope of the Act of 14 July 1991, the consumer has the right to inform the seller that he renounces the purchase, without payment of a fine and without giving a reason, within 7 working days from the day following delivery . If the consumer invokes this option, he must return the goods in their original condition and packaging at his own risk and expense to Bam.coffee, Venusbergstraat 53, Paal (Belgium). Products can only be returned after permission from Bam.coffee and must be accompanied by the invoice. The product will then be replaced or refunded (see 'returns'), depending on the availability of the product and the wishes of the customer.
Personal data
When purchasing products or services, the buyer explicitly agrees that his/her personal data may be used for administrative purposes, such as creating and maintaining a customer database, tracking orders, shipments and invoices, and checking invoices. solvency. Personal data will only be processed for promotional purposes, personal advertising and/or other (re)marketing purposes.
Bam.coffee will never pass on this personal information to third parties unless explicitly requested by legal authorities or when it is legally required to do so. The buyer has the right to change or view his/her personal information at any time. Evidence
Within the framework of their relationships, the parties involved accept the electronic evidence.
Severability
If an article of these conditions is declared null and void, this nullity will not affect the validity of the other articles.
Bam.coffee is entitled to change the content of these General Terms and Conditions. Changes will be announced via the website.
Applicable law
All agreements concluded with the seller are governed by Belgian law. The Belgian courts have exclusive jurisdiction.
